Image, Voice and Participation Release
What each person who appears in a recording or in a photograph published here authorizes. It applies to agents, guests and companions.
This English version is a courtesy translation. If it differs from the Spanish version, the Spanish version prevails.
01 Why Florida requires this in writing
Florida has its own statute: the unauthorized publication of a person's name, portrait or likeness for commercial purposes (Fla. Stat. 540.08) allows that person to seek an order stopping the use, damages, a reasonable royalty and, on top of that, PUNITIVE DAMAGES. Consent must be EXPRESS. A guest who arrived, sat down and recorded did not give express consent just by being present.
02 What you authorize
That your image and your voice be recorded during your participation, and that this material — together with your name, your company's name and your title — be published and promoted on the office's site, on the podcast sub-site, on its audio channel, on the office's social channels and in promotional pieces for that same content.
03 What you do NOT authorize, so it is clear what you are not giving
You do not authorize the use of your image to advertise a product or a service other than the episode or the content you took part in. You do not authorize being presented as endorsing a specific property, investment or offer. You do not authorize any transfer of ownership of your image: you grant permission to use it for the purposes above, and nothing more.
04 No payment
Participation is voluntary and generates no payment, royalty or share of revenue, unless a separate written and signed agreement says otherwise.
05 How to withdraw it
You may withdraw your authorization going forward by notifying the operations coordination team in writing. The material is unpublished from the channels the office controls. What has already been distributed to audio platforms or downloaded by third parties cannot be pulled back — which is why this release is signed BEFORE recording, not after.
06 Minors
The participation of a person under eighteen requires the written authorization of their parent or legal guardian, delivered before the recording. Without that document there is no recording, no exceptions.
07 Recording requires the consent of EVERYONE present
Florida requires the consent of all parties to record a communication (Fla. Stat. 934.03). This is not an administrative infraction: it is a criminal matter. Whoever books the studio commits to ensuring that every person who enters the room knows they are being recorded and agrees to it, including companions and anyone who walks in partway through the session.
08 What you represent by participating
That you are of legal age or bring the authorization of the appropriate person; that what you say is your own and you answer for it; that you will not disclose a third party's confidential information or a client's personal data; and that no contract of yours with another company prevents you from participating.
09 How your authorization is recorded
Platform users give it when they accept the legal documents at sign-in, and the system records who accepted, which version and when. Guests without an account give it in writing before recording, on the form provided by the coordination team, and that document is filed with the episode. An authorization that was not recorded is an authorization that does not exist: that is why no recording is published without one.
